====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-08-2023 Heard learned counsel for the petitioner, learned counsel for the O.P. No.2 and learned APP for the State. 2.

The petitioner apprehends his arrest in a case registered for the offence punishable u/s 323 and 498A of the IPC. 3.

At the very outset, learned counsel for the petitioner submits before the Court that petitioner-husband is ready and willing to keep his wife (O.P. No.2) with full honour and dignity at her matrimonial home and learned counsel for the O.P. No.2 also submits that O.P. No.2 is ready to live with the petitioner. 4.

It is submitted by learned counsel for the petitioner that petitioner is working in the B.S.F. and posted at Ganga Nagar,

Patna High Court CR. MISC. No.69482 of 2022(3) dt.25-08-2023 2/2 Rajasthan.

Having considered the submission of the parties, let the above named petitioner, be released on provisional bail for a period of six months from today, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Complaint Case No.1113 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. 6.

Petitioner is directed to go to the parental house of his wife (O.P. No.2) and bring her to her matrimonial house and thereafter file an affidavit before the learned Court below stating therein that he has brought his wife with him. 7.

Thereafter, the provisional bail of the petitioner shall be confirmed by the learned court below itself after ascertaining this fact that the O.P. No.2 and petitioner are living together at the house of the petitioner.
