The petitioner, mother-in-law of the complainant/opposite party no. 2, has approached this Court with a prayer to extend the privilege of anticipatory bail in Complaint Case No. 2300 of 2014 for offence under Sections 498(A), 406 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act, 1961.
Learned counsel for the petitioner, by way of referring to facts disclosed in the complaint petition, submits that in the complaint petition, save and except the allegation that she
Patna High Court Cr.Misc. No.55021 of 2016 (2) dt.23-12-2016 2/2 (petitioner) was passing comment against the complainant, there is no other accusation. According to learned counsel for the petitioner, allegation has mainly been levelled against the husband of the complainant.
Considering the facts and circumstances, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Zahoor Negar @ Buchhun Khatoon @ Zahoor Nejar - E be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj in connection with Complaint Case No. 2300 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
