1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner is apprehending his arrest in connection with Harsidhi P.S. Case No. 216 of 2021 registered for the offences punishable under Sections 341, 323, 324, 147, 148, 149, 307, 504, 354 and 34 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that petitioner has antecedent of three cases, but then two cases are of the year 2004. It is next submitted that from perusal of the

No.59940 of 2025(2) dt.11-09-2025 2/3 allegation as alleged in the F.I.R., it would manifest that petitioner along with Bali Pandit is alleged to have assaulted the informant by farsa causing injury on head, thereafter other accused are also alleged to have assaulted the side of the informant by farsa, bhala, Barchhi iron rod etc. causing injury, it is next submitted that no doubt informant and Rana suffered six and five injuries respectively, but then all the injuries have been opined to be simple, except one i.e. injury suffered by the informant on shoulder, but then petitioner is not alleged to have assaulted the informant on shoulder.

The learned APP for the State opposes the anticipatory bail application and submits that from perusal of the allegation as alleged in the FIR, it would manifest that petitioner along with Bali assaulted the informant. It is next submitted that Bali Pandit has been granted the privilege of regular bail by this Court by an order dated 05.07.2022 in Criminal Miscellaneous No. 12775 of 2022.
5. The learned counsel appearing on behalf of the petitioner, at this stage, seeks permission to withdraw the anticipatory bail application with liberty to surrender before the learned Trial Court seeking regular bail.

7. It is made clear if the petitioner surrenders on or before 08.10.2025, in that event, the learned Trial Court shall dispose of the case keeping in mind that Bali Pandit has been granted the privilege of regular bail by this Court.
8. Accordingly, the instant anticipatory bail application is dismissed as withdrawn with the liberty aforesaid.
