Apprehending his arrest in Rajpur P.S. Case No. 92 of 2016 registered under sections 147, 148, 323, 384, 383, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act, the present application is for grant of anticipatory bail. The informant was returning from the Counting Centre along with his supporter. It is alleged that co-accused intercepted the two vehicles. Co-accused Kalika Yadav is said to have pulled him out from the vehicle and said to have assaulted. Other coaccuseds are said to have assaulted one Santosh Kumar. Contention of the petitioner is that out of the political rivalry, the present case has been lodged. The informant did not receive any injury. The injury received by Santosh Kumar was opined to be simple/superficial. Considering the above, co-accused

Patna High Court Cr.Misc. No.53961 of 2016 (2) dt.21-12-2016 2/2 Umesh Yadav @ Umesh Singh who is said to have assaulted Santosh Kumar who was riding the bus, has been granted anticipatory bail vide order dated 29.11.2016 passed in Cr. Misc. No. 43451 of 2016. The petitioner has no criminal antecedent. In the event of arrest or surrender in the Court below within four weeks, the petitioner abovenamed is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in Rajpur P.S. Case No. 92 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions:

(i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
