ANJANA MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 30.05.2017 in connection with a case registered for the offences punishable under Sections 341/323/307/504/506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that some altercation took place between the parties for connection of the line of the transformer, but the injuries which are purported to have been inflicted by the petitioner, have been found to be on the right thigh. It is submitted that there was no repetition of injuries so as to attrac Section 307 nor was it pre-meditated and had occurred on the spur of the moment.

Considering the aforementioned submissions and also that the petitioner has already been custody for more than 3 1⁄2

Patna High Court Cr.Misc. No.41182 of 2017 (2) dt.20-09-2017 2/2 months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Banka (Barahat) P.S. Case No. 19/2017.
