Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 86 of 2022 registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code and Section 8 of POCSO Act.

As per the prosecution, the informant's minor daughter aged about sixteen years was kidnapped on the alleged date. The main submissions advanced by learned counsel Mr. Tej Kumar Maharaj, appearing for the petitioner are that the

No.63988 of 2022(2) dt.25-02-2023 2/2 petitioner who is a lady is not named in the FIR and the main allegation is against co-accused Vikas Kumar who has been granted bail by the Court below and the victim has been recovered and during investigation the petitioner was roped merely on the basis of statement of some witnesses and she has been languishing in jail since 29.05.2022 having fair and clean antecedent and the co-accused Vikas Kumar happens to be nephew of this petitioner.

Learned APP Mr. Ajay Kumar Jha, appearing for the State has opposed the prayer for bail.

In view of the facts, as stated above, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Jehanabad P.S.
