The petitioner seeks regular bail in connection with Jamalpur (Workshop) PS case no. 03 of 2015 registered for the offences punishable under Section 3(a) R.P. (U.P.) Act. The accusation against the petitioner is based on the confessional statement of one Ambika Ram, rickshaw puller who has disclosed that the petitioner herein and three others were also involved in stealing the property of railway. The learned counsel for the petitioner submits that no incriminating article has been recovered from the possession of the petitioner, the petitioner is innocent and is languishing in jail since 24.07.2017.
In the facts and circumstances of the case, I deem it fit and appropriate to direct the release of the petitioner on regular
Patna High Court Cr.Misc. No.45490 of 2017 (2) dt.19-09-2017 2/2 bail immediately upon completion of 03 months from the date of custody i.e. 24.07.2017 to the satisfaction of learned Railway Judicial Magistrate, Kiul at Lakhisarai in Jamalpur (Workshop) PS case no. 03 of 2015 on such terms as may be deemed appropriate by the learned trial court.
With the aforesaid observation, the instant petition is disposed of.
