2. The petitioner is apprehending his arrest in connection with Barhara P.S. Case No. 612 of 2022 under Sections 147, 149, 447, 341, 323, 307, 504, 506 of the Indian Penal Code.
3. As per prosecution case, the allegation against the petitioner is that he assaulted the informant by iron rod on his head, causing head injury.
4. Learned counsel for the petitioner submits petitioner is innocent and has falsely been implicated in this case. Both the parties are agnates and there is a land dispute between the parties. The injury is simple in nature. It is further submitted that petitioner is ready to cooperate with the
Patna High Court CR. MISC. No.63173 of 2023(2) dt.17-10-2023 2/2 investigation. Petitioner has no criminal antecedent.
5. Learned APP opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of the learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Barhara P.S. Case No. 612 of 2022, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
