JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-07-2016 Heard Mr. Ansul for the petitioner and the State. Indisputably, according to the petitioner, the subject land is recorded as the Anabad Bihar Sarkar. The petitioner was elected as Mukhiya of the Gram Panchayat and in a gram sabha meeting it was resolved that the subject land be used by the public at large. It is stated that the private respondents are forcibly utilizing the land as cemetery.
After making submissions at some length, counsel for the petitioner prays for disposal of the writ application granting
Patna High Court CWJC No.24710 of 2013 (2) dt.20-07-2016 the petitioner liberty to invoke the relevant jurisdiction of the authority/forum for redressal of the grievance as raised in this application.
The writ application, as prayed, is permitted to be withdrawn with the said liberty.
