JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-03-2024 The present writ petition has been filed seeking the following relief:- "(i) For quashing the order contained in Memo No. 1232 dated 12.9.2022 issued by the commissioner Bhagalpur Division Bhagalpur in Misc. (Anganbari) Revision Case No.

53/2020-21 whereby although order of District Programme Officer Bhagalpur dated 25.9.2020 in Misc. (Aaganbari) Case

Patna High Court CWJC No.15316 of 2022(2) dt.12-03-2024 2/3 No.64/2019-20 has been set aside but the petitioner was not reinstated on the post of Anganbari Sevika rather the D.P.O. Bhagalpur has been directed to initiate a fresh selection Proceeding.

(ii) For quashing the order dated 25.9.2020 passed by the District Programme Officer Bhagalpur in Misc. (Anganbari) Case No.

64/2019-20 whereby the selection of the petitioner to the post of Anganbari Sevika has been cancelled and Respondent No.9 was directed to be selected/ appointment as Sevika in place of the petitioner.

(iii) For a direction to the respondent concerned to reinstate the petitioner on the post of Anganbari Sonat Sevika of Centre No.237 ward No.3, Srimatpur Gopali Chak Panchayat, Pirpainti Bhagalpur."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.
