The petitioner is languishing in custody in a case registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code. The accusation is of killing the daughter of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. For the alleged occurrence of 17.07.2022, the F.I.R was registered on

Patna High Court CR. MISC. No.59297 of 2022(3) dt.04-02-2023 2/2 01.08.2022 without explaining the delay. The petitioner is distant relative of the husband of the deceased and he has no concern with the alleged crime. The petitioner is languishing in custody since 08.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 565 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
