The petitioner seeks bail in connection with Banshi P.S.Case No.38/15 for the offence under Sections 302/120B of the I.P.C. and Section 27 of the Arms Act.

There is direct allegation against the petitioner is of firing on the brother of the informant, namely Ranveer Kapoor on account of which he died.

Having regard to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected.

However, on perusal of the report at Flag 'B' it appears that the witnesses have remained absent from the court.

Patna High Court Cr.Misc. No.35902 of 2017 (3) dt.20-12-2017 2/2 The S.P., Jehanabad, is directed to ensure the presence of all the witnesses so that the trial should be concluded on day to day basis, on failure in complying this order the court will start proceeding against the S.P..
