The petitioner apprehends his arrest in a case registered for the offence under Section 420/34 & other allied sections of the Indian Penal Code and Section 63 of the Copy Rights Act.

As per the prosecution case, all the F.I.R. named accused persons, including petitioner, were selling fake product of Lakme brand.

It is submitted on behalf of petitioner that petitioner has been made accused only on suspicion because the shop of the petitioner is situated near Manihari Store, where raid was conducted. No incriminating article has been recovered from possession of this petitioner. Other similarly situated co-accused

Patna High Court CR. MISC. No.59674 of 2022(2) dt.16-03-2023 2/2 persons have already been granted anticipatory bail by this Court, vide order dated 16.08.2022 in Cr.Misc. No. 12672/2022 (Brijesh Prasad Gupta), order dated 22.08.2022 in Cr.Misc. No. 13169/2022 (Zubair Ahmad) and order dated 26.09.2022 in Cr.Misc. No. 31946 of 2022 (Ejaj Ahmad and Md. Hasnain) respectively. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 617 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
