The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 379 and 34 of the Indian Penal Code. It is alleged that the accused persons surrounded the informant and started abusing when petitioner no.1 put country made pistol on his chest and asked him to withdraw the earlier case, otherwise he was given life threatening. The accused persons assaulted the informant and resorted fire. It is further alleged that the accused persons snatched gold chain and money from the pocket of the informant.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.55268 of 2015 (2) dt.07-12-2015 2/2 that in the background of serious land dispute with regard to passage, the accusation has been levelled and the injury has been found to be simple in nature. Earlier, the informant also lodged a case against the brother of the petitioners.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Bhabua P.S. Case No.162 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
