JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-11-2017 The petitioner seeks regular bail in connection with Alamganj P.S. Case No. 164 of 2015, registered for offences punishable under Sections 406 and 409 of Indian Penal Code. Allegation against the petitioner is of defalcation of huge amount from GPF account of the several persons from Government Treasury and depositing the same into his own account and in the account of his mother.

It has been submitted on behalf of the petitioner that the has falsely been implicated in this case and it is not possible for the petitioner to get the code of Drawing & Disbursing Officer and if any defalcation has been made the said Drawing & Disbursing Officer has to be made responsible and not the petitioner and further it is a case triable by Magistrate. He has been in custody

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
