This is and application for grant of anticipatory bail for offences punishable under Sections 406, 420, 467, 468, 471, 323/504 of the Indian Penal Code.

Allegation against the petitioner is that he took Rs. 3,00,000/- from the complainant/informant on the pretext that he will provide the informant a Government Job as disclosing himself to be the nephew of the Ex-Chief Minister.

It has been submitted on behalf of the petitioner that the falsity of the case appears from fact that for the alleged offence, this case has been lodged after a period of six years and no cheat of paper has been annexed to show that the petitioner has cheated

Having heard both sides. In view of the fact that there is nothing to support the allegation of the informant, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-XIII, Gopalganj, in connection with Fulwariya P.S. Case No. 01 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunil/- U T
