JUSTICE BIRENDRA KUMAR ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 308, 379 and 504/34 of the Indian Penal Code. Both sides are family members. For land dispute, the petitioners, allegedly, committed assault and theft. It appears that co-accused, namely, Babulal Singh and others have already been allowed anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 44275 of 2016 on 22.10.2016.

Let, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with

Patna High Court Cr.Misc. No.52573 of 2016 (2) dt.08-12-2016 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Delha Police Station Case No. 127 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
