The petitioner, in the present case, is seeking regular bail in connection with Pothia P.S. Case No.67 of 2017, registered for offences alleged under Section 394 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report though, two mobiles phones, which are said to have been looted from the informant, have been recovered from the possession of the petitioner. Learned counsel further submits that the said mobile was kept in the house of the petitioner by one Md. Khairul, who is relative of this petitioner and the petitioner had no knowledge of the fact that it was a looted mobile.

Patna High Court Cr.Misc. No.36375 of 2017 (2) dt.10-08-2017 Learned APP opposed the prayer for bail.

Considering the fact that the investigation in the present case is over and that the petitioner has no criminal antecedent, let the petitioner, namely, Saiful Rahman be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kishanganj in connection with Pothia P.S. Case No.67 of 2017 (G.R.No.593 of 2017), subject to the conditions U/S 437(3) Cr.P.C.
