2. A supplementary affidavit with regard to jointness of the opposite party no. 2 with her father has been filed on behalf of the petitioner. Let the same be accepted.

3. Heard learned counsel for the petitioner and learned A.P.P. for the State.

4. The petitioner seeks bail in connection with Katihar Cyber P.S. Case No. 21 of 2024 dated 24.03.2024 registered for the offences punishable under Sections 341, 323, 504, 506, 292 of the I.P.C. and Sections 66E and 67A of the I.T. Act.

5. As per the prosecution case, the informant was

Patna High Court CR. MISC. No.66010 of 2024(4) dt.22-04-2025 2/3 married to the petitioner with Hindu customs 6-7 years ago. It is further alleged that for the last one year, the petitioner used to abuse and assault the informant and on protest, she was tried to burn after pouring kerosene oil on her body. The petitioner always pressurized her for money from her father but who is not in a position to fulfill the aforesaid demand. The petitioner made the obscene picture of the informant and her sister viral by writing dirty words on Facebook. It is further alleged that due to the aforesaid reason, the informant alongwith her family members is facing mental torture and the reputation in the society is also getting damaged.

6. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner alongwith two mobile holders are named accused in the present case alleging the general and omnibus allegation to viral the personal photo of the informant. There is some personal dispute between the petitioner and the informant. The informant herself left her matrimonial house and went away to her parental house without any reason. It is further submitted that the petitioner made attempts for several times to get Bidagari of his wife from her parental house but she did not agree to go to her matrimonial

Thereafter, the petitioner filed a petition before the learned Principal Judge, Family Court, Purnea, on 13.12.2023 for restitution of conjugal life, thereafter, the present case has been filed on 24.03.2024. The petitioner never demanded money from the informant. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 05.05.2024.

7. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Katihar in connection with Katihar Cyber P.S. Case No. 21 of 2024.

9. The application stands allowed.
