Mr. Pankaj Kumar For the Opposite Party/s :

Mr. Satya Nand Shukla ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 14-09-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

2. This is an application under Section 482 of the CrPC for setting aside the order dated 26.07.2021 in Cr. Misc No. 12/2020 passed by learned District and Session Judge Shiekhpura.

3. Learned counsel for the petitioner has submitted that the Opposite Party No. 2 after getting anticipatory bail made pressure on the petitioner/informant to compromise the case and also he was threatening the informant. His petition for cancellation of bail was rejected by a detailed order passed by learned Sessions Judge, Shiekhpura. Learned Sessions Judge,

Patna High Court CR. MISC. No.1243 of 2022(2) dt.14-09-2023 2/2 has mentioned in his order that the petitioner failed to substantiate that the Opposite Party No. 2 Manoj Singh was putting pressure and giving threats to the petitioner to compromise. Considering these facts, the learned Sessions Judge has rejected the petition filed by the petitioner.

4. Relying upon a decision of Aslam Babalal Desai Vs. State of Maharashtra 1992(4) SCC Page 272 and Raghubir Singh Vs. State of Bihar 1986(4) SCC Page 481, in which the grounds for cancellation of bail have been dealt with at length. The learned Sessions Judge has rejected the petition filed by the petitioner.

5. The order of the learned Sessions Judge is well reasoned. In my view, it doesn't need interference by this Court.

6. Accordingly, the present criminal miscellaneous petition is dismissed.

7. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
