====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 27-02-2026 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 20 and 22 of the N.D.P.S Act.

3. As per the prosecution case, 463 gm of brown sugar was recovered from the motorcycle in question and petitioner along with other was apprehended on the spot.

4. Learned counsel for the petitioner submits that the recovery has been made from the motorcycle which does not belong to the petitioner and is registered in the name of the wife of the coaccused. Further, there is no independent witness to the search and seizure and the petitioner has been languishing in custody since 14.03.2025 with no criminal antecedent.

5. Learned A.P.P. opposes the bail on the ground that 463 gm of brown sugar was recovered which is commercial quantity and

6. Taking into consideration the facts and circumstances of the case and also considering the allegation of commercial quantity which has been recovered from his conscious possession, this court is not inclined to grant bail to the petitioner.

7. As such, the application is rejected.
