Petitioner apprehends arrest in connection with Town (Sikarndarpur O.P.) P.S. Case No. 882 of 2021 registered for the offence under section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from a bush in the lane near the Balughat Brahmsthan, which is an open place. Petitioner has no concern with the seized article. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.63382 of 2023(2) dt.16-10-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 1, Muzaffarpur in connection with Town (Sikandarpur O.P.) P.S. Case No. 882 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
