====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Fesar P.S. Case No.55 of 2025 instituted under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 46.5 litre illicit Indian made foreign liquor which was loaded on a motorcycle bearing Registration No. BR-24S-2610 and it is alleged that the petitioner alongwith co-accused Pappu Kumar were riding the said motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that the name of petitioner has been implicated in this case only on the basis of disclosure made by the villagers. Learned counsel submits that no incriminating article has been recovered from the conscious possession of petitioner. He further submits that the recovery of alleged seized liquor including the

Learned counsel submits that petitioner himself surrendered before the Court concerned on 04.08.2025 and since then he is in custody, having one criminal antecedent, in which he is on bail. He further submits that similarly situated co-accused, namely, Pappu Kumar has been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 09.07.2025 passed in Cr. Misc. No.42280 of 2025. Learned counsel submits that there is no likelihood of absconding the petitioner or tampering with the evidence and he undertakes to cooperate in the investigation and trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-II, Aurangabad/ concerned Court in connection with Fesar P.S. Case No.55 of 2025.
