2. The petitioner seeks bail in connection with Daraunda P.S. Case No. 141 of 2023 registered for the offence punishable under Sections 341/323/324/325/307/504/34/ of the Indian Penal Code. Later on Section 302 of the Indian Penal Code.

3. The petitioner and others are accused of killing the deceased.

4. The allegation against the petitioner is that he had assaulted the deceased with a Kulhari (a sharped edged weapon) and others also assaulted him due to which he died.

5. The date of occurrence is 14.05.2023 and the date

6. Learned counsel for the petitioner has submitted that in the postmortem report, there is no injury caused by sharp edged weapon which shows that the informant is not a eyewitness of the occurrence. The petitioner is in jail since 25.07.2023.

7. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

8. In view of the above, this application is allowed.

9. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Siwan/concerned court in connection with Daraunda P.S. Case No. 141/2023.

10. Petitioner will co-operate in the trial.

11. The petitioner will appear in the trial personally or through his Lawyer on the date fixed failure to do so will result in the cancellation of the bail bonds of the petitioner. (Sandeep Kumar, J) Saif/- U
