The petitioner seeks bail in a case instituted under Sections 395 and 412 of the Indian Penal Code. It is alleged that three unknown miscreants having armed with pointed weapons snatched the bags containing Rs. 15, 25, 639/- from two guards, who were proceeding for transporting the same for banks.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.06.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.55375 of 2016 (3) dt.20-03-2017 2/2 petitioner is not named in the F.I.R. He has not been put on Test Identification Parade to ascertain his involvement in the present case. There is no recovery of any incriminating article from the possession of the petitioner. The other co-accused have been granted bail vide Annexure-2 series to the present application. On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri B.K. Tripathi, J.M.1st Class, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 1126 of 2014.
