The petitioners apprehend their arrest in Barauli P.S. Case No.154 of 2019, registered under Sections 341, 323, 354, 307, 447, 379, 504, 506 and 34 of the Indian Penal Code. The informant named altogether nine persons including the two petitioners, Vijay Singh and Ramayan Singh and alleged that they all came at her darwaza and assaulted her with fists and slaps on the order of Vijay Singh, petitioner no.1. Vijay Singh is said to have also assaulted the informant with farsa on her head. When her husband Subhash Singh came, Bakil Prasad assaulted him.

Learned counsel for the petitioners submits that the occurrence took place on 08.05.2019. The FIR was lodged on

Patna High Court CR. MISC. No.58493 of 2019(2) dt.19-09-2019 2/2 14.05.2019. Prior to institution of the case, from the side of the petitioners Barauli P.S. Case No.151 of 2019 was registered. The petitioners are agnates of the informant and on account of some land dispute, some scuffle took place for which the petitioner no.1 lodged a case on 10.05.2019 itself but the informant after having come to know about the institution of the case on behalf of the petitioners lodged the criminal case making false and frivolous allegations. Injuries found on the persons of the informant and her husband (Annexure-3 and 4) are superficial and simple in nature.

Having considered the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Gopalganj in connection with Barauli P.S. Case No.154 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
