The petitioner seeks bail in a case registered for the offence under Sections 365, 302,201,120(B)/34 of IPC. Earlier the prayer for bail of the petitioner was refused vide order dated 04.04.2022 passed in Cr. Misc. No.59292 of 2021.

Learned counsel for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. Petitioner is in custody since 15.02.2021. Vide order dated 16.11.2022 a report regarding present status of the trial was called for. Report reveals that the trial is going on and as per impugned order out of six, four have been examined and the record is fixed for examination of the

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with S.Tr.No.579 of 2021 arising out of Ballia P.S.Case No.36 of 2021 pending in the court of learned Additional Sessions Judge-II, Begusarai. Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
