====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-09-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in case registered for the offences punishable under Sections 341, 342, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, on the alleged date and time of occurrence, these petitioners along with other F.I.R. named and two unknown persons assaulted informant with bricks on his head and looted cash and other articles.
4. Learned counsel for the petitioners submits that petitioners are innocent and they have been made accused only on the basis of information disclosed by the persons assembled
Patna High Court CR. MISC. No.63585 of 2024(3) dt.25-09-2024 2/2 at the place of occurrence. Informant has not identified these petitioners. No stolen articles have been recovered from possession of petitioners. Petitioners claim clean antecedent.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. and there is specific accusation of assault against them due to which informant sustained multiple injuries.
6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioners is refused.
