The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 363, 366 (A), 120B of the Indian Penal Code.

The allegation against the petitioner along with others is of kidnapping the daughter of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He submitted that the petitioner is not named in the FIR. He further submitted that the victim girl has been recovered and she stated in her statement recorded u/s 164 of the Cr.P.C., that she does not whisper about the complicity of this petitioner. Patna High Court CR. MISC. No.63122 of 2022(3) dt.29-03-2023 2/2 solemnized marriage with this petitioner on her will. The petitioner has got no criminal antecedent as stated in para-3 of the bail application. The petitioner is languishing in judicial custody since 05.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Basantpur (Lakdi Naviganj) P.S. Case No. 567 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan.
