The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(i), 26 and 41 of the Bihar Prohibition and Excise Act.

It is contended that as per allegation, 286.5 litres of foreign liquor were recovered from the Tata Sumo Victa but there is no recovery from the petitioner and on the basis of the statement of co-accused Phul Kumar Choudhary and others the petitioner has been named in the FIR. No.36287 of 2017(2) dt.10-08-2017 2/2 case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Madhubani Town P.S. Case No. 155 of 2017 (G.R. No. 135 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
