JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-04-2023 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of a writ in the nature of writ of certiorari to quash the notice dated 29.06.2019 issued by the Circle Officer Bodh Gaya, Gaya in Encroachment Case No.

03/2019-20 directing the petitioner's Late father to vacate the plot no. 530 of Khata no. 508 lying under Mauza Mastipur, Police Station Bodh Gaya, Gaya, for which second Appeal No. 79 of 2017 is pending in the Hon'ble High Court Patna.

(ii) For issuance of a writ of Mandamus directing the Collector Gaya not to disturb the peaceful possession of the petitioner over the land lying on plot no. 530 of khata no.

508 in Mastipur Mauza under Bodh Gaya

Patna High Court CWJC No.18424 of 2019(3) dt.12-04-2023 2/2 Police Station in the district of Gaya as the aforesaid land was decreed in petitioner's favour vide Judgment dated 24.04.2010 passed in Title Suit No. 317 of 2007 by the learned Sub Judge 1st Gaya.

(ii) For issuance of a writ of certiorari to quash the notice dated 25.07.2019 issued by the Additional Collector Gaya in Mutation cancellation case No. 07/2013-14 as the mutation of suit land was done on the basis of decree passed in Title Suit no. 317 of 2007 by the learned Sub Judge 1 Gaya."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty so sought is granted.

The writ petition stands dismissed as not pressed.
