This application is filed for modification of the order dated 08.08.2023 passed in Cr. Misc. No.30591 of 2023, whereby the bail application of the petitioner was dismissed as withdrawn.

It is submitted by learned Senior counsel for the petitioner that due to inadvertence and communication gap, learned counsel for the petitioner conveyed to Hon'ble Court that petitioner is willing to withdraw the bail application and as such

Patna High Court CR. MISC. No.66402 of 2023(2) dt.06-10-2023 2/2 Hon'ble Court was pleased to dismiss the case as withdrawn, however, the petitioner never intended to withdraw the case. 4.

Having gone through the order dated 08.08.2023 passed in Cr. Misc. No.30591 of 2023, it is clear that on the prayer of learned counsel for the petitioner himself, the case was dismissed as withdrawn. As such, there is no ground and I am not inclined to entertain this modification application. 5.

It is accordingly, dismissed.
