JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 354 and 504/34 of the Indian Penal Code. The prosecution case is that when the informant made protest for storing bricks adjacent to his wall by his neighbour Arun Singh then he started abusing by calling caste name and also assaulted with Khanti on the head of the informant and when the mother of the informant came to rescue then the petitioners assaulted the informant and his mother. It is also alleged that the petitioner Abhay Kumar snatched gold chain and petitioner Ranjan Kumar snatched gold earring of the informant and his mother.

Patna High Court Cr.Misc. No.56940 of 2015 (2) dt.17-12-2015 2/2 It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled. The injuries of both the injured have been found to be simple superficial in nature. Though, for the occurrence of 31.05.2015, the Fardbeyan was recorded on the same day but the FIR was registered on 07.06.2015. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the genesis of occurrence, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Nawada in connection with Nardiganj P.S. Case No. 58 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
