Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection

Patna High Court CR. MISC. No.71433 of 2021(2) dt.29-07-2022 2/3 with Pachrukhi P.S. Case No. 123 of 2021 registered for offence punishable under sections 147, 148, 149, 341, 504, 447, 323, 324, 379, 354, 504 and 506 of the Indian Penal Code. As per allegation, co-accused Sajid @ Raja was driving rashly and hit the son of the informant. The informant's son became injured. On protest, ten named accused persons came to the darbaja of the informant and they badly assaulted the informant side.

The learned counsel for the petitioners has submitted that both the parties are co-villagers. There is case and counter case. The petitioners are the persons of clean antecedent. There is no specific allegation against the petitioner Mr. Abbas @ Md. Ali Abbas. Though, there is specific allegation against Asif Ali. Two persons to whom there is an allegation to assault have sustained simple injuries.

Considering the above-mentioned facts and circumstances, specially the clean antecedent of the petitioners, let them, in the event of their arrest or surrender, within four weeks from today, released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVI, Siwan in connection with Pachrukhi P.S. Case No. 123 of

Patna High Court CR. MISC. No.71433 of 2021(2) dt.29-07-2022 3/3 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
