1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Chapra Mufassil Police Station Case No. 156 of 2024, dated 19.03.2024, disclosing offences under Sections 366 (A) of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that the grand-daughter of the informant has been kidnapped by the co-accused Govinda. When the informant went to the house of the petitioners to enquire about his missing grand-daughter, the petitioners abused him and threatened him to kill if the case is lodged.

Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in the present case merely because he happens to be the mother and sister of the co-accused Govinda with whom the victim was having love relationship. When the victim-girl came back, her statement was recorded under Section 164 of the Code of Criminal Procedure, wherein, she has stated that on her free will she had gone with the co-accused Govinda and performed marriage with him.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the the fact that the petitioners are mother and sister of the co-accused Govinda, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra, in connection with Chapra Mufassil Police Station Case No. 156 of 2024, subject to
