The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 307 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a woman having clean antecedent and the informant alleges that petitioner called and took informant's mother Amerika Devi to her house where the husband of the petitioner Jawahar Sah caught the mother of the informant by her hair and torn her cloths and even assaulted her with sharp weapon on chest, waist and left hand. It is alleged that he also gave Kulhari blow on her back and head causing injuries due to which she became unconscious and when Vishal Kumar tried to save her,
Patna High Court CR. MISC. No.72067 of 2021(2) dt.02-08-2022 2/3 then the accused person also caused injuries upon his neck with a sharp cutting weapon, accordingly both the injured were sent to hospital.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that though the name of the petitioner figures in the body of the fardbyan but in the accused column she has not been made an accused, it is next submitted that she came to be implicated merely because she is wife of Jawahar Sah who had assaulted the mother of the informant, as such the informant in order to falsely implicate the petitioner alleged that it was she who called his mother to her house where the occurrence took place.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is
