Petitioner prays for grant of anticipatory bail in Turkaulia (Banjaria) P.S. Case No. 430 of 2016 registered under sections 272, 273, 353 and 34 of the Indian Penal Code and Sections 47, 51 and 54 of the Bihar Excise (Amendment) Act, 2016. The S.I. along with the police personnel, in course of checking of the vehicle got information that accused persons were involved in manufacturing illicit liquor. The house was according searched of co-accused Kishori Sah and Anil Sah wherefrom illicit country made liquor and other materials/articles were found. A motorcycle was also found in the dicky whereof the liquor was stored. In effecting seizure, the mother of those two accuseds obstructed rigorously. On going through the F.I.R., it appears the
Patna High Court Cr.Misc. No.53890 of 2016 (2) dt.20-12-2016 2/2 petitioner has an active role to play in the alleged commission of crime.
In my view, the petitioner should surrender and pray for grant of bail. Prayer is rejected. The Court below on her surrender and making application for bail shall consider the same on its own merit unprejudiced by the present order.
