JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Naubatpur P.S. Case no. 250 of 2016, registered under Sections 354 of the Indian Penal Code.

The accusation is that in the morning of 20.08.2016, the sister of the informant had gone to attend the call of nature in the field. At that time, this petitioner persuaded her and on the point of pistol, the petitioner pulled her in orchard then she made alarm. On hearing the sound of crying villagers rushed there then petitioner fled away. Learned counsel for the petitioner submits that, in fact, the petitioner and the informant are Gotiya and next door neighbour and there is land dispute in between the parents of the informant and petitioner due to that reason, this false case has been lodged, this fact

Patna High Court Cr.Misc. No.55778 of 2016 (2) dt.16-01-2017 2/2 has also come in the statement of the witness Laxman in para 17 of the case diary. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Danapur, Patna in connection with Naubatpur P.S. Case No. 250 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
