1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Dumraon Police Station Case No. 118 of 2016, dated 03.05.2016, disclosing offences under Sections 290/34 of the Indian Penal Code and Sections 47/54 of the Bihar Prohibition and Excise Act.
3. The prosecution story, as per the written report, is that on 03.05.2016, during patrolling, the police found a Scorpio vehicle in suspicious condition near Guru Training School, Dumraon. On seeing the police, 4-5 persons fled away taking advantage of darkness. On search of the vehicle, bearing Reg. No. BR-03Q-0007, a total of 280 bottles of rum (180 ml each) were recovered from two bags, which were seized along with the vehicle.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case only because he happens to be the registered owner of the said vehicle. The petitioner resides in Dubai and was not present at the place of occurrence. He next submits that the police, after investigation, has submitted final form exonerating the petitioner, not sending him for trial, however, learned Magistrate has differed from the final form and has taken cognizance against the petitioner. He further submits that the vehicle, from where illicit liquor has been recovered, was being driven by his driver Arjun Singh for personal work and the petitioner had no knowledge about illicit liquor being kept therein.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the the petitioner resides in Dubai and he has been made accused only because he happens to be the registered owner of the vehicle, which was being driven by his driver Arjun Singh, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest
Patna High Court CR. MISC. No.62498 of 2025(2) dt.24-09-2025 3/3 or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court 1, Buxar, in connection with Dumraon Police Station Case No. 118 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
