2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 120(B), 302, 201 of the Indian Penal Code.
3. As per prosecution case, one unidentified dead body of a female was found on the bank of Dharmavati river, which was recovered. It is alleged that she was committed murder by unknown persons.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was surfaced during course of investigation. The victim is identified by her uncle as Priyanka Devi who was a pregnant lady and she was
Patna High Court CR. MISC. No.65332 of 2023(3) dt.03-01-2024 2/2 living in her Mausa-Mausi place and no injury was found on her dead body. No one is eye witness of the alleged occurrence. No any consistent material has come to connect the petitioner with the alleged occurrence. He has falsely been implicated in this case. The petitioner has got no criminal antecedent and languishing in judicial custody since 19.6.2023. Moreover, similarly situated co-accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dt. 15.5.2023 passed in Cr. Misc. Nos. 73441 of 2022 and 73541 of 2022.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Rajpur P.S. Case No. 231 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-V, Buxar.
