JUSTICE SHAILENDRA SINGH ORAL ORDER 29-08-2025 Petitioner seeks regular bail in connection with Maharajganj P.S. Case No. 261 of 2025 dated 30.05.2025 registered for the offences punishable under Sections 103, 117(2) and 3(5) of the Bharatiya Nyaya Sanhita.

2. Heard Mr. Shievendra Kumar Sinha, learned counsel for the petitioner, Mr. Mohammad Sufyan, learned APP for the State and also, perused the FIR as well as the trial court's order.

3. In the facts and circumstances of this case, and mainly considering petitioner's the pleas that the FIR was registered two days after the commission of the alleged occurrence and as per the informant, there was some enmity between the deceased and the co-accused Sanjay Kumar Ray,

No.59464 of 2025(2) dt.29-08-2025 2/2 but no details regarding the said enmity has been revealed by the informant in the FIR, coupled with the fact that the petitioner is said to be the driver of the said co-accused and the informant did not reveal any enmity between the deceased and this petitioner, and also taking into account the custody period of the petitioner, his fair and clean antecedent, and the completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Maharajganj P.S. Case No. 261 of 2025.
