JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 In the present writ petition manifold grievances have been raised by the petitioner. From the pleadings it appears that the petitioner had joined service in Rohtas Industries and thereafter he claimed that he may be allowed to join as teacher in the school but that request was rejected by the D.E.O., Sasaram in the year 1984. After 13 years of such rejection when the petitioner superannuated from Rohtas Industries he again represented the respondents to allow him to join duty in the school and he also represented the Education Department for his retirement benefits.

The petitioner claims that the Managing Committee of the school accepted the joining of the petitioner as Science Teacher on 7.8.1986 and on the strength of Annexure-3 he

Patna High Court CWJC No.13505 of 2012(3) dt.06-07-2018 2/2 submits that in view of acceptance of joining by the Managing Committee of the school, he is entitled to be recognized as Science Teacher and also entitled to the benefit thereof. Earlier the petitioner had filed CWJC No. 12479 of 2005 which was disposed of on 11.5.2011 with an observation that the undisputed amount may be paid to the petitioner. Now the grievance in the present writ petition is that the Chief Secretary has rejected the claim of the petitioner. So far as the claim of the petitioner with regard to the admitted amount, the same has been paid by the respondents. Considering the totality of the fact situation, the Court is not in a position to enter into the said controversy and grant any indulgence.
