The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 188, 269, 272, 147, 148, 149, 341, 323, 448, 353, 307, 427, 333, 337 and 379 of the Indian Penal Code.

The prosecution case is that the police party forbade the persons from assembling at the house of one Pankaj Ravidas in big number and asked them to disperse because of the Corona protocol, the police party was attacked and two of the police men have received injuries.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no specific allegation of overt-act

Patna High Court CR. MISC. No.71609 of 2021(2) dt.20-07-2022 2/2 against the petitioner and specific allegation of overt-act is against only Pankaj Ravidas. He further submits that several similarly situated co-accused persons have been granted anticipatory bail by the different Benches of this Court. Petitioner has got clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Bhagalpur in connection with Ishipur Barahat P.S. Case No. 26 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
