2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 25(1B)a,26 and 35 of the Arms Act, registered in connection with Raghopur P.S.CaeNo. 65 of 2024.
3. As per allegation, the informant along with other police personnel, in course of patrolling, noticed some suspicious activities of the accused persons, including the petitioner. On seeing the police party, they started fleeing away, but were overpowered. On search, a country-made pistol from the waist of the petitioner was recovered.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.65945 of 2024(2) dt.25-09-2024 2/2 that the petitioner is innocent and the entire allegation is false and fabricated. The petitioner was not present at the place of occurrence, rather he was somewhere else. He is in custody since 25.02.2024. It is further submitted that co-accused Md. Rustam has been granted bail by the learned court below.
5. It appears that the petitioner has three criminal cases to his credit.
6. In my view, it is not a fit case to grant the privilege of bail to the petitioner. It is accordingly rejected.
7. However, the petitioner may renew his prayer for bail in the court below itself after six months which shall be considered without being prejudiced by the order of this Court. (Nawneet Kumar Pandey, J) nirmal/- U T
