JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in G.O. Excise Case No. 141 of 2017 arising out of Simri P.S. Case No. 09 of 2017 instituted for the offence under Section-30(A) of Bihar Prohibition and Excise Act, 2016 and Sections-399, 402 of the Indian Penal Code and 25(i-B)A of the Arms Act.

It is alleged that an iron knife has been recovered from possession of the petitioner. The petitioner is in custody since 18-022017. The other co-accused Santosh Kumar has already been granted bail by coordinate bench of this court vide order dated 10-07-2017 passed in Cr. Misc. No. 31243 of 2017.

In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with G.O. Excise Case No. 141 of 2017 arising out of Simri P.S. Case No. 09 of 2017 to the satisfaction of 3rd
