JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Jokihat P.S. Case No. 277 of 2014, registered under Sections 302, 201 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits that on the basis of the written report of the Chowkidar, Jhallu Manjhi, Jokihat P.S. Case No. 277 of 2014 was instituted against unknown with regard to recovery of male dead body. Later on, dead body was identified as of Phool Babu by his brother Akbar. In course of investigation, Police got confessional statement of Sajjad @ Daida, father of the

No.55231 of 2015 (3) dt.01-02-2016 petitioners, who disclosed the name of the petitioners and others and confessed about committing the murder of the deceased with the help of these petitioners and others. Except the aforesaid confessional statement, there is nothing on the record to show the complicity of the petitioners in the commission of the alleged offence. Moreover, co-accused Sajjad @ Gaida and Furgun @ Rubi have been granted privilege of bail by a Bench of this Court on 03.04.2015 passed in Criminal Miscellaneous No. 47544 of 2014. The petitioners are in custody since 01.10.2015. Having regard to the facts and the circumstances of the case, the above named petitioners, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Araria in connection with Jokihat P.S.
