NILU AGRAWAL ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Petitioner seeks bail in connection with Paroo P.S. Case No. 97/2017 for offences punishable under Sections 302, 34, 120-B of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that while he and his brother Ram Pravesh Singh (deceased) were on way home in a T.V.S. Moped, the petitioner along with four others and four unknown persons stopped them and took out a dagger. The informant fled away but heard co-accused Bimal Singh giving orders to kill the brother of the informant. When he came back he found throat of his brother slit and various wounds

Patna High Court Cr.Misc. No.42218 of 2017 (2) dt.21-09-2017 2/3 on his body. During course of treatment he succumbed to the injuries.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, there was a land dispute between the parties and the present case is a counter-blast to the case lodged by the petitioner's side bearing Paroo P.S. Case No. 135/2016 in which charge-sheet has been submitted against the informant and his family members. He submits that charge-sheet has already been submitted, there is no allegation of tampering of the prosecution witnesses by the petitioner and he is languishing in custody since 03.05.2017. It is submitted that two of the co-accused, who was alleged to be the order giver and another co-accused Surendra Singh have been granted privilege of bail by coordinate Benches of this Court.

Patna High Court Cr.Misc. No.42218 of 2017 (2) dt.21-09-2017 3/3 denied to the petitioner.

Learned APP for the State also opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, I am not inclined to grant privilege of bail to the petitioner at this stage in connection with Paroo P.S. Case No. 97/2017, pending in the court of learned S.D.J.M. (West), Muzaffarpur.

Application is, accordingly, rejected.

However, petitioner may renew his prayer for bail after framing of charge. (Nilu Agrawal, J) Rajesh/- U T
