The petitioner, who is in custody since 30.09.2015 in connection with Araria ( Bairgachhi ) P.S. Case no.234 of 2015 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. However, during investigation, on the basis of confession of one of the co-accused, petitioner's name has transpired in this case. He further submits that the petitioner is having clean antecedent, which has been stated in paragraph-3 of the petition. It has been argued that one of
Patna High Court Cr.Misc. No.55399 of 2015 (2) dt.18-12-2015 2/2 the co-accused, namely, Md. Sawood Alam @ Saud , almost in similar situation, has been granted bail vide Cr.Misc.No.55740 of 2015.
Keeping in view the fact that one of the co-accused almost in similar situation has been granted bail, nature of accusation as well as clean antecedent, which has been mentioned in paragraph-3 of the petition, let the petitioner, namely, Ram Kumar Rai @ Ram Kr. Roy be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria ( Bairgachhi ) P.S. Case no.234 of 2015.
