====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Shubhesh Pandey, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 01.04.2017 in Phulwariya P.S. Case No.37 of 2017 registered for the offence under Sections 399, 402 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act,2016 as well as Section 25(1-b)a, 26/35 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that recovery of one pistol with four cartridges as well as Indian Make foreign liquor were shown from possession of the petitioner and after being arrested in the present case, he was subsequently made accused in another case, otherwise, according to learned counsel for the petitioner, the petitioner

Patna High Court Cr.Misc. No.34365 of 2017(3) dt.15-09-2017 2/2 was having clean antecedent.

Considering the nature of accusation and period of custody, let the petitioner, namely, Neeraj Kumar @ Neeraj Chaudhary be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Addl. Sessions Judge, Begusarai in connection with Phulwaria P.S. Case No.37 of 2017.
