2. The petitioner is in custody since 07.10.2016 in connection with Complaint Case No. 252(c) of 2015 for the alleged offences under Sections 406 and 420 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated in connection with certain deposits having been made at the Birpur Branch of Koshi Central Co-operative Credit Society Ltd., (for short "the Society") in which the petitioner was the Loan Manager. In this regard Birpur P.S. Case No. 117 of 2013 had already been instituted in which the petitioner had already

Patna High Court Cr.Misc. No.2126 of 2017 (3) dt.10-02-2017 enlarged on bail. The present complaint has been filed two years thereafter by the complainant who was a Collecting Agent of the Society. The petitioner is on bail in all the cases in which he has been made accused.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Birpur, Supaul in connection with Complaint Case No. 252(c) of 2015 on the following conditions - (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iv) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) Chandran/BT U T
